New EU rules mean Brits will now get LESS compensation if their flight is delayed
A CHANGE to a European travel rule will mean that Brits will get less compensation if their flight is delayed.
Currently, legislation called EU261 means that European air passengers are entitled to compensation if their flight is delayed by over three hours or cancelled.
And despite leaving the European Union in 2020, the UK decided to adopt this regulation into law – meaning that British travellers benefit from the same rule as European travellers.
The regulation however went under review in Brussels back in April and it has now been decided that the amount of time a flight is delayed by before getting compensation has increased.
Currently, Brits can get compensation if their flight is delayed for three hours or more, for short-haul flights under 3,500km.
However, the new rules mean this will be increased to four hours – so anything less than this won’t be eligible for compensation.
For longer flights (over 3,500km), airlines will now pay compensation if flights land at least six hours late – up from the current four-hour standard.
And how much compensation can be given has changed as well.
Under the new rules, €300 (£252.75) compensation will apply for delays of more than four hours, rather than €400.
And €500 (£421.25) compensation will apply to delays of more than six hours involving flights of more than 3,500km, rather than €600.
However, the agreement to extend delay times and cut compensation has been met with some opposition, including from Spain and Germany.
Despite this, the Council bypassed discussions with the European Parliament and made its decision legally binding using a process that has not been used in more than a decade.
The European Parliament, however, can still make changes to the new rules.
From now, it has four months to respond to the suggested new riles with a proposal that must be backed by a majority of 361 MEPS.
If approved, the current EU Air Passenger Rights Regulation rules – where passengers can claim between €250 (£210.62) and €600 (£505.50) in compensation if a flight is delayed by at least three hours, if the delay is the fault of the airline – will be scrapped.
Other compensation rules will remain unchanged.
If the delay or cancellation is due to an ‘extraordinary circumstance’, compensation will not be paid.
These circumstances usually include extreme weather, political instability, security risks or issues with air traffic control.
Strikes are usually not considered to be extraordinary circumstances and the same with routine mechanical issues or staff shortages.
Whilst this rule covers airlines that are registered in the EU or flights taking off from and EU or Schengen zone country, since Brexit the British government has pretty much copied the rules into UK legislation.
This means, that if the new rules are also not opposed by European Parliament, it looks likely that the UK government would also enshrine it into legislation.
This week, Brits have also been stranded in Spain as easyJet cancels scores of flights over ATC restrictions.

BRYDON CARSE was so worried about his toe injury that he considered AMPUTATION.
Durham fast bowler Carse revealed: “At one stage, I was going to bed thinking, ‘I could actually do this – I could get rid of my second toe.’
“But the medical staff said I need the toe for my balance so it was quickly ruled out.
“I’m going to have to keep it a little longer!”
The impact of Carse’s bowling has caused problems with his left foot for several years but it became so bad last winter that he pulled out of the Champions Trophy and the IPL.
He is back now and playing in the white-ball matches against West Indies.
The T20 series starts today on his home ground at Chester-le-Street.
He will also be a key man in the Test series against India.
Carse, 29, added: “My feet are not the most ideal thing.
“Everyone has an opinion on my second toe!
“In the winter, it ended up being quite a severe wound and I got a couple of infections.
“I’ve changed a few things – I have a narrower boot and new insoles.
“They’re working well at the moment.”

Car ploughs into pedestrians at UK tourist attraction in horror early hours crash – as man arrested
A MAN has been arrested after a car smashed into pedestrians at a UK tourist attraction.
Cops were called at around 3:15am this morning to reports of a car ploughing into a lamppost and two pedestrians on North Parade, Bath.
One of the pedestrians was rushed to hospital and is being treated for non-life threatening injuries.
Three of the car’s passengers were also taken to hospital as a precaution.
The suspected driver has been arrested on suspicion of dangerous driving and drink driving.
Cops have since launched an appeal for information, calling on witnesses or anyone in the area with dashcam footage to come forward.
In a statement, Avon and Somserset police said: “A man has been arrested following a collision in Bath in the early hours of this morning.
“We received a 999 call to a serious injury collision on North Parade, Bath, at around 3.15am this morning (Friday 6 June).
“We received reports a car collided with a lamppost and two pedestrians.
“There were four people in the car at the time of the collision and the suspected driver has been arrested on suspicion of dangerous driving and driving while over the prescribed alcohol limit.
“One of the pedestrians has been taken to hospital with serious injuries, which are not thought to be life threatening, while three passengers from the car were also taken to hospital as a precaution.
“We are now appealing for any witnesses and anybody who may have CCTV or mobile phone, doorbell or dashcam footage of the incident or the events leading up to it to call us on 101 quoting reference.”
Two men, 20s, rushed to hospital after horror crash between two motorbikes & car as road closed amid ‘ongoing’ probe
TWO men have been hospitalised following a horror crash between two motorcycles and a car in Co Kildare.
The incident, which left both motorcyclists with injuries, occurred on the R415 in Boley Little, Athy Co Kildare.
Gardai and emergency services raced to the scene of the crash at around 7.30pm yesterday evening.
One of the men on a motorbike, who is aged in his 20’s, was taken straight to Tallaght Hospital.
He is being treated for serious injuries.
The second motorbike driver, also a man in his 20’s, was brought to the Midland Regional Hospital in Portlaoise.
He is being treated for injuries believed to be non life threatening.
No other injuries were reported from the scene of the collision.
The road was closed off so that members of a Garda Forensics Examination team could investigate the scene.
And Gardai have appealed for witnesses, calling on anyone with information which might be useful to come forward.
A spokesperson for the force said: “Gardai are appealing for witnesses to this incident to come forward.
“Any road users who may have camera footage (including dash-cam) and were travelling in the area between 7.15pm and 7.45pm are asked to make this footage available to investigating Gardai.
“Anyone with any information is asked to contact Athy Garda Station on (059) 8634210, the Garda Confidential Line on 1800 666 111, or any Garda Station.
“Investigations are ongoing.”
FATAL CRASH
The incident took place just minutes before a fatal crash in the same county.
A teenager was killed following a single-vehicle crash involving a pick-up truck on the Barrettstown Road in Newbridge shortly after 8pm last night.
The young man, who is aged in his late teens and was a passenger of the pick-up truck, was taken to Naas General Hospital and pronounced dead a short time after the crash.
A second man in his late teens, who was driving the vehicle, was taken to Tallaght Hospital for treatment of non life-threatening injuries.
There were no other injuries reported.
Gardai confirmed that investigations into the fatal crash are “ongoing” and urged anyone who may have witnessed the incident to come forward.

GEORGINA RODRIGUEZ’S Netflix show is set to be cancelled after she raked in a £22million payday.
The partner of Portugal superstar Cristiano Ronaldo has revealed that ‘I Am Georgina’ will not be getting a fourth series.
The 31-year-old, who gave fans a look at her glamorous life in the show, took home a whopping £22m for the first three seasons.
Rodriguez was also executive producer for the item, which went down a storm with supporters.
It made the top 10 most-viewed programmes in 46 countries.
And the first season’s success spawned two renewals.
However, Rodriguez has now confirmed ‘I Am Georgina’ will not return for a fourth time.
She told Vogue Arabia: “The reality show has been one of the most important professional experiences and the one that has made me the most excited.
“It has been a lot of work and requires so much effort.
“I think that it has given me the opportunity to show the real ‘me’ to the world.
“It has been the most important and large-scale project that I have done so far.
“However. at the moment, I do not plan to continue with the reality show.”
Georgina famously met former Manchester United and Real Madrid star Ronaldo while working as a shop assistant in the Spanish capital.
The pair have been together since 2016 and share two children together.
Georgina is also stepmother to Ronaldo’s three other children.
While the couple suffered heartache when they lost one of their twins during childbirth in 2023.
